Lifts and hoists
Equipment that is used for lifting people such as passenger lifts, lifting platforms for wheelchairs etc. is subject to the Lifting Operations and Lifting Equipment Regulations 1998 (LOLER). The Health and Safety Executive have published an Approved Code of Practice and guidance for its use. There is a statutory duty for equipment that falls under LOLER to be fit for purpose, inspected regularly, and for records of inspections and maintenance to be kept.
Provision and Use of Work Equipment Regulations 1998 (PUWER) may apply to lifting equipment, and a similar inspection and maintenance regimen will be required to comply with these regulations.
Some equipment will not be subject to LOLER or PUWER, however, Health and Safety Executive guidance states that those in control of equipment are responsible for the safety of all users under Section 3 of the Health & Safety at Work etc Act 1974 and will require similar undertakings for the proper maintenance of equipment.
