Property schedule for your block

This Written Statement of Service should be read in conjunction with your Property Schedule at Appendix A. The Property Schedule details information regarding your own shared block including the core and non-core services the Council as property factor will provide for the management of your block.

In carrying out its role as property factor on behalf of the homeowners, the Council must adhere to the terms of the homeowners’ title deeds and where these fail to address any issue then the Council will be guided by the terms of the Tenements (Scotland ) Act 2004 (‘the 2004 Act’) which is legislation to fill any gaps or contradictions in individual property titles. Generally, the homeowners title deeds will take precedence and the 2004 Act will only be used where the title deeds fail to deal adequately with an issue.

If you don’t have a copy of your title deeds, you can obtain a copy at Registers of Scotland. If you have bought you home since 2001 you should be able to get a copy from Registers of Scotland. There is small charge for this service (£3 as at Feb 2020). If you have owned your home longer than that then you will need to email Registers of Scotland

In this case the fee will be higher.

Your solicitor may be able to provide you with a copy of your title deeds.
