Appeals and unpaid penalty charges
You may appeal against a penalty charge (known as a 'representation') through a formal appeals process. Appeals will follow Section 8 of the Low Emission Zones (Emission Standards, Exemptions and Penalty Charges) (Scotland) Regulations 2021.
If you do not pay penalty charge notice within the 28-day payment period, and we do not receive a representation, we can issue a ‘charge certificate’. A charge certificate increases the penalty charge amount by 50%. If the increased charge is not paid within 14 days, we can recover the charge certificate (and penalty charge) as an 'enforceable debt'. This means will pursue the vehicle owner for the payment through a legal process.
