Who is responsible for repairs and maintenance?
All owners in a building are responsible for
- its safety and maintenance (this responsibility extends beyond the areas of your own property or flat and includes the common areas in the block)
- paying their share towards repairs and maintenance of common areas. The Council represents council owned flats in buildings and funds their share of the costs.
In mixed tenure blocks, parts of the block are shared between all the owners - these are known as common areas (e.g. the roof, external walls and stairs).
Your title deeds contain rules about how costs are to be split within the block. If the deeds do not explain the cost split, then there are legal rules that need to be followed to allocate the costs.
Property factors
If you live, or own a flat, in a block where the Council
