Searching for statutory notices on a property

You can search for a Statutory Notice on your property via the Planning and Building Standards portal.

The information provided will show you the identity/reference number of any Notice outstanding against the property. It will in addition give the date the Notice was served. It will also note if the Council has enforced work under the Statutory Notice and whether an account has been issued to the owners. Until all accounts are paid for all flats the Statutory notice will remain against the building.
If you are thinking of selling your property and need to know if the account for your property has been paid, you will need to write to the Council at the address given to obtain confirmation on the status of the account. Only a property owner or their agent can do this, a potential purchaser or third party can not obtain this information as the data is protected under the Data Protection Act 1998, which protects the personal information of the owner.

How to use the system

Open the P&BS Portal for access to this service. You will need to register to carry out a search but registration is free. At the search screen you will need to enter either the address, e.g. 228 Gorgie Road or alternatively, the post code e.g. EH11 2PN.
Do not enter both sets of details.

The search result should show those addresses which match the address entered. Choose the one that matches the address you wish to search against. Click in “select” and you will see the search result. If there is no date shown then there are no Statutory Notices found. Please ensure that you have entered the correct address.

The result

The first column is the reference number for the Statutory Notice. These are shown in different formats and simply reflect the variety of numbering systems used in the past.
The second column provides the date the Statutory Notice was served.
In the third column is shown the text we hold against the Statutory Notice, this may also be in different styles and format.
The fourth column states whether an account has been issued. Please note that “no account” indicates that the Statutory Notice may not yet have been enforced or that work is underway but has not been completed. If you think that an account has been paid but it still shows as being outstanding then this may be because another owner may not have paid their account and the Statutory Notice remains on the building until the last share has been paid.

Detailed information regarding Statutory Notices and their issue is provided in the Council publication “About your Statutory Notice, an Advisory Guide”. This and other publications on the repair of buildings are available on the Council web site.
If you are the owner of the property or your agent, a copy of the Statutory Notice can be obtained by making an application in writing to Property Conservation at the address shown. You will need to quote the property address, and the Notice reference number with date it was issued. It is a requirement that you also confirm that you are the owner of the property or are an agent acting on behalf of an owner who you must name in your information request. This also applies to enquiries regarding whether accounts have been paid or not.

This web site is part of the Council’s scheme of publications and the data is made available to meet the Council’s obligations under the above Act.
Please note that detailed information regarding Statutory Notice and relative accounts is only available to the property owners or their agents. Applications made by parties who are not an owner or the agent of an owner will have their request rejected on the grounds that the information is exempt as it is controlled by the Data Protection Act.
