Councillors Code of Conduct

The Ethical Standards in Public Life etc. (Scotland) Act 2000 introduced a new ethical framework to Scotland. It demonstrates a strong commitment by Parliament to promote high standards in public life and helps to reinforce public confidence in Councillors.

The Act requires the Scottish Ministers to issue a Councillors Code of Conduct.  The Code was drafted in consultation with local government and approved by Parliament. It took effect from 1 May 2003.

The Code sets out the standards of conduct that must be applied.  Following election, Councillors must sign a formal Declaration of Acceptance of Office in which they undertake to meet the requirements of the Code. They cannot carry out any functions as a Councillor until they have done so.

The Standards Commission for Scotland - in co-operation with the Chief Investigating Officer - is responsible for the enforcement of the Code.  All allegations of misconduct, properly made, will be investigated and, where necessary, appropriate sanctions will be applied.
